Yup.  They said this before the bill was passed, and the increase
in spam since the law went into effect has seemed to bear this out.
And it can embolden those who were holding off because of the
extremely strict laws in some states, which the CAN-SPAM bill
nullified by having the Federal law supercede all state laws.

And end users have no one to complain to, as the ISP has to be
the one initiating the complaint.

I'd say 'email your congressman' but it would probably get lost.
